Subject: Complaint regarding non-refund of ₹20,000 for cancelled wedding photography service



Respected Sir/Madam,



I, Savan Patoliya, residing at 17/C, Avani Park Society, Rajesh Tower, Subhanpura, Vadodara – 390023, am writing to lodge a formal complaint against Mr. Dhruv Bedekar, a wedding photographer based in Vadodara, for refusing to refund ₹20,000 paid in advance for a service that was subsequently cancelled.



On 21st November 2020, I paid ₹20,000 to Mr. Bedekar for covering my wedding ceremony scheduled to be held in a village near Junagadh. However, due to personal reasons, I cancelled the booking within 4–5 days of payment and informed him promptly. Despite the early cancellation, Mr. Bedekar refused to refund the amount, citing a “no cancellation” policy. However, no such policy was ever communicated to me verbally or in writing at the time of booking.

As a person with a hearing disability, I believe I was unfairly taken advantage of. The refusal to refund the amount without any documented terms or agreement constitutes a clear case of deficiency in service and an unfair trade practice under the Consumer Protection Act, 2019. Furthermore, under the Rights of Persons with Disabilities Act, 2016, I am entitled to equal treatment and protection against exploitation.



As a person with a hearing disability, I believe I was unfairly taken advantage of. The refusal to refund the amount without any documented terms or agreement constitutes a clear case of deficiency in service and unfair trade practice under the Consumer Protection Act, 2019 [Sections 2(6), 2(47), and 35]. Furthermore, under the Rights of Persons with Disabilities Act, 2016 [Sections 3(3), 7, and 12], I am entitled to equal treatment, protection from exploitation, and access to justice with reasonable accommodation.



It has now been nearly five years since the incident, and despite repeated efforts, the amount remains unpaid. This prolonged delay has caused me significant mental distress and financial hardship. I believe this also reflects a violation of my dignity and rights as a person with a disability.



I respectfully request the Commission to take appropriate action and direct the service provider to:

- Refund the full amount of ₹20,000

- Provide suitable compensation for the mental distress, delay, and inconvenience caused

- Ensure that my rights under the RPWD Act are upheld during the proceedings

- Screenshots of communication

Additionally, I request that a sign language interpreter or other appropriate support be provided during any hearings or proceedings, in accordance with my rights as a person with a disability.
