Respected Sir/Madam,

I, Sachin Ravi Patole, a resident of Saki Vihar Road, Powai, Andheri (East), Mumbai – 400072, wish to draw your urgent attention to a serious and hazardous incident involving the consumption of contaminated Heineken Silver Beer, served at a licensed restaurant in Mumbai.

On 18 October 2024, at around 1:40 p.m., I, along with a companion, visited CHERISH Restaurant & Bar – Family Restaurant (FL No. 3-1649) located at Saki Vihar Road, Powai, beside Nuclear House Building, Andheri (East), Mumbai – 400072.

We ordered Heineken Silver Beer along with our meal. After consuming only a few sips, we immediately detected a strong foul odor and bitter, unpleasant taste. On closer inspection, we found an algae-like sticky substance floating inside the beer bottle, which was clearly visible upon pouring into another glass. The contamination was documented through video evidence recorded at the restaurant.

Despite repeatedly alerting the restaurant staff, the waiter initially denied responsibility, and only after insistence, the manager acknowledged the issue, apologizing and claiming to have contacted a Heineken company representative. However, no representative arrived even after two hours, indicating a gross lapse in consumer grievance response from both the restaurant and the manufacturer.

This incident raises grave concerns about food safety standards, product quality control, and negligence under the Food Safety and Standards Act, 2006, and the Consumer Protection Act, 2019. Contaminated beverages of this kind pose a serious health risk to the public and could lead to adverse health effects or poisoning.

I hereby request urgent intervention and action as follows:
Immediate investigation by the Department of Consumer Affairs and FSSAI into the quality and safety of Heineken Silver Beer batches supplied to Mumbai.

Inspection and penal action against the concerned restaurant for serving unsafe consumables.

Direction to United Breweries Holdings Ltd (Heineken India) to identify, recall, and test affected product batches to prevent recurrence.

Award appropriate compensation for the mental agony, distress, and potential health risk caused. I hereby claim ₹5,00,000 (Rupees Five Lakhs) as compensation under the Consumer Protection Act, 1986.

Formal written explanation from the company and restaurant on their failure to respond to an on-the-spot consumer complaint.

Before submitting the present grievance, I have already raised multiple complaints to the National Consumer Affairs Department regarding the same issue. Despite repeated follow-ups and earlier grievances, no effective action or resolution has been provided so far. Therefore, I am compelled to escalate this matter for urgent attention and appropriate intervention.
