I am writing this complaint against Shiv Shakti Construction and its promoter/representative, Mr. Pralay Kumar Das, regarding the non-refund of my flat booking amount of ₹1,90,000 despite cancelling the booking several months ago.
I had initially booked a residential flat at a project located near Nayabad, South Kolkata, West Bengal. In connection with this booking, I paid a total amount of ₹1,90,000 to the builder/promoter through the following payment transactions:
₹1,00,000 through IMPS transfer.
₹40,000 through NEFT transfer.
₹50,000 transferred to the promoter's bank account.
Unfortunately, no formal agreement for sale, allotment letter, or proper booking receipt was provided to me.
After approximately one month, due to personal circumstances, I decided to cancel the flat booking and requested a refund of my entire booking amount.
Initially, I was even willing to accept a reasonable deduction of 5–10% from the booking amount to settle the matter amicably. However, despite my willingness to resolve the issue peacefully, the builder has failed to refund my money.
It has now been almost four months since the cancellation, but I have still not received my refund. The promoter has neither provided a satisfactory explanation nor taken any concrete steps to return my money. Communication has also become extremely difficult.
I would also like to highlight that, to the best of my knowledge, the project was not registered with the West Bengal Real Estate Regulatory Authority (WBRERA). Furthermore, no formal contractual documentation was provided to protect my interests as a homebuyer.
Legal Action Already Taken
After repeatedly requesting the refund without receiving any satisfactory response, I was left with no option but to approach the West Bengal Real Estate Regulatory Authority (WBRERA).
I have already filed a complaint with WBRERA and paid the prescribed complaint fee of ₹1,000.
My grievance was registered under Serial No. 1507/2026 and was subsequently forwarded to the South 24 Parganas Regional Office on 14 October 2026.
However, despite taking these steps, I have not yet received a satisfactory resolution or recovered my money.
Financial and Mental Harassment
This prolonged delay has caused me considerable financial hardship, mental stress, and unnecessary harassment.
The money involved is my hard-earned savings. I had arranged this amount for an important personal and family requirement. Due to the promoter's failure to return my money, I am facing significant financial difficulties.
It is extremely disappointing that a homebuyer who has paid money in good faith has to spend months pursuing a builder simply to recover their own money.
Relief and Action Requested
I respectfully request the concerned authorities and consumer protection bodies to look into this matter and help me obtain the following relief:
A full refund of the booking amount of ₹1,90,000.
Reasonable interest on the withheld amount for the entire period of delay.
Appropriate compensation for mental harassment, financial hardship, and inconvenience.
Reimbursement of reasonable legal expenses and other costs incurred in pursuing this matter.
Appropriate legal action against the builder/promoter if any violation of applicable real estate or consumer protection laws is established.
I am prepared to provide all supporting documents, including bank transaction records, payment proofs, communications with the promoter, and WBRERA complaint acknowledgement.
I sincerely request assistance in recovering my hard-earned money and ensuring that other prospective homebuyers do not face similar situations.
I am not asking for any unfair benefit. I am simply demanding the return of my own money, which has been withheld by the builder for several months without a satisfactory explanation.
