Facts of the Case:
- On 24 June 2022, I paid an advance amount of ₹15,000 to India Furniture for making a custom sofa.
- On 2 July 2022, I paid the remaining amount, making the total payment ₹48,500, for which I possess valid receipts.
- The sofa was delivered to my residence; however, it was not made as per agreed specifications.
- The seat width is insufficient, making it uncomfortable to sit.
- The foam quality is extremely poor, causing users to slip inside the seat.
- Due to this defect, my family members and I have suffered back pain and spent additional money on medical treatment.
- Multiple complaints were made to Raishbhai Suthar, but no corrective action was taken.
- Finally, we requested the seller to take back the sofa and sell it, and refund the amount.
- On 17 February 2025, India Furniture collected the sofa from our house.
- Even after 10 months, the sofa has not been sold, no refund has been made, and the seller has stopped responding to calls and messages.
Deficiency in Service & Unfair Trade Practice:
- Supplying a defective product
- Ignoring customer complaints
- Taking back the product without refund
- Causing financial, physical, and mental harassment
Relief Sought:
I humbly request the Honorable Commission to direct the opposite party to:
- Refund the full amount of ₹48,500, or at least the amount recovered from selling the sofa
- Pay compensation for mental harassment and medical expenses
- Pay litigation costs
- Any other relief deemed fit by the Honorable Commission
