Facts of the Case:


  1. On 24 June 2022, I paid an advance amount of ₹15,000 to India Furniture for making a custom sofa.
  2. On 2 July 2022, I paid the remaining amount, making the total payment ₹48,500, for which I possess valid receipts.
  3. The sofa was delivered to my residence; however, it was not made as per agreed specifications.
  4. The seat width is insufficient, making it uncomfortable to sit.
  5. The foam quality is extremely poor, causing users to slip inside the seat.
  6. Due to this defect, my family members and I have suffered back pain and spent additional money on medical treatment.
  7. Multiple complaints were made to Raishbhai Suthar, but no corrective action was taken.
  8. Finally, we requested the seller to take back the sofa and sell it, and refund the amount.
  9. On 17 February 2025, India Furniture collected the sofa from our house.
  10. Even after 10 months, the sofa has not been sold, no refund has been made, and the seller has stopped responding to calls and messages.



Deficiency in Service & Unfair Trade Practice:


  • Supplying a defective product
  • Ignoring customer complaints
  • Taking back the product without refund
  • Causing financial, physical, and mental harassment



Relief Sought:


I humbly request the Honorable Commission to direct the opposite party to:

  1. Refund the full amount of ₹48,500, or at least the amount recovered from selling the sofa
  2. Pay compensation for mental harassment and medical expenses
  3. Pay litigation costs
  4. Any other relief deemed fit by the Honorable Commission
