COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019


1. PARTICULARS OF THE PARTIES:


The Complainant is an individual, residing in Hyderabad, Telangana, and is a "consumer" as defined under the Consumer Protection Act, 2019. The Opposite Party (OP), DMI Finance Private Limited, is a Non-Banking Financial Company (NBFC) engaged in providing lending services, with its registered office in New Delhi and also operating through its customer care/local branches.


2. FACTS OF THE CASE:

  1. The Complainant availed a loan from the Opposite Party under Account No. DM10001029885.
  2. Following a settlement offer made by the Opposite Party, the Complainant duly paid the total outstanding amount of ₹22,230/- (Rupees Twenty-Two Thousand Two Hundred and Thirty Only) on 30.11.2020.
  3. Upon successful settlement and closure of the loan account, the Opposite Party issued a "Settled & Closed" intimation/No Objection Certificate (NOC) on 30.11.2020, explicitly confirming that the account was closed in their internal records and was reported as such to the Credit Bureau, namely TransUnion CIBIL.
  4. However, a CIBIL report procured by the Complainant, dated 02.04.2025 shockingly reveals that the Opposite Party reported/updated this already settled and closed account again on 31.12.2024. After subsequent complaints to the customer care by mail, the customer care assured it shall be resolved in 25 to 28 working. However, a CIBIL report procured by the Complainant dated,25.02.2026 shockingly reveals it’s never been updated.
  5. This repeated and incorrect reporting of a long-closed account after a period of over four years since its settlement and the issuance of an NOC, clearly demonstrates gross negligence and constitutes a "deficiency in service" on the part of the Opposite Party, actionable under the provisions of the Consumer Protection Act, 2019.

3. GRIEVANCE:

The arbitrary and negligent act of the Opposite Party in misreporting data to TransUnion CIBIL and potentially other credit bureaus, years after the complete settlement and closure of the loan account, has caused immense mental agony, harassment, and severe prejudice to the Complainant's creditworthiness and financial standing. Despite issuing an official No Objection Certificate, the Opposite Party has failed to maintain accurate and updated records, leading to incorrect information being disseminated to credit reporting agencies, which is a clear case of unfair trade practice and deficiency in service.

4. PRAYER:

It is, therefore, most respectfully prayed that this Hon’ble Commission may be pleased to:
  • A. Direct the Opposite Party to immediately correct the records with TransUnion CIBIL and all other relevant credit bureaus to accurately reflect the correct loan settlement and closure date of 30.11.2020 for Account No. DM10001029885 and provide proof of such correction to the Complainant within a stipulated timeframe.
  • B. Direct the Opposite Party to pay compensation of ₹25,00,000 for the mental agony, harassment, loss of reputation, and potential financial prejudice caused to the Complainant due to the erroneous and negligent reporting.
  • C. Direct the Opposite Party to pay ₹50,000 towards the litigation expenses incurred by the Complainant in pursuing this complaint.
  • D. Pass any other order(s) as this Hon’ble Commission deems fit and proper in the facts and circumstances of the present case, in the interest of justice.
