COMPLAINT
1. The complainant is a consumer within the meaning of the Consumer Protection Act, 2019, having availed accommodation services from the Opposite Party hotel on payment of consideration.
2. The complainant had booked accommodation with the Opposite Party and paid an advance amount of Rs. 2,000/- (Rupees Two Thousand only), which was expressly refundable.
3. On the date of check-out, i.e., 7 February 2026, the said advance amount was not refunded by the Opposite Party.
4. Upon telephonic enquiry, the Opposite Party assured the complainant that the refundable advance would be credited within five working days from 7 February 2026.
5. Despite the lapse of the promised period and repeated follow-ups, the Opposite Party has failed to refund the said amount. The conduct of the Opposite Party amounts to deficiency in service and unfair trade practice.
6. The unjustified retention of the complainant’s money, coupled with false assurances, has caused mental agony, inconvenience, and financial loss to the complainant.
7. The cause of action arose on 7 February 2026 and continues as the Opposite Party has not refunded the amount to date.
8. The complainant resides within the territorial jurisdiction of this Hon’ble Commission; hence this Hon’ble Commission has jurisdiction to entertain and adjudicate this complaint.

PRAYER
The complainant respectfully prays that this Hon’ble Commission may be pleased to:
a) Direct the Opposite Party to refund the advance amount of Rs. 2,000/- forthwith;
b) Award compensation for mental agony and harassment caused due to deficiency in service;
c) Award costs of these proceedings;
d) Grant such other reliefs as this Hon’ble Commission may deem fit and proper in the interests of justice.
