Hi all,

I’m an Indian citizen currently residing in Japan, but I’ll be returning to India permanently in early August. I’m seeking legal advice on whether I can file a consumer complaint in India under the Consumer Protection Act, 2019, in the following situation:
  • I purchased an iPad Pro 11-inch (2022 model) from the official Apple Store in Japan in January 2024.
  • In June 2025, the Apple Pencil 2 stopped being detected. Diagnostics at multiple Apple Stores in Japan confirmed it as a hardware failure, but they refused to disclose technical details or a detailed diagnostic report—only an expensive out-of-warranty repair estimate (~¥100,000 or ~INR 60,000).
  • The device was lightly used and showed no physical or liquid damage, which store technicians also acknowledged.
  • One technician admitted this was an extremely rare failure in his experience.
  • The iPad was temporarily used in India for about 6 months during the warranty period with no issues.
  • I have proof of purchase, support case logs, diagnostics screenshots, and store visit records.
  • Apple has a registered business presence in India (Apple India Pvt Ltd., Bengaluru) and markets this product with the same claims of durability and environmental responsibility in both countries.
Given this, I have three specific questions:
  1. Can I file a consumer complaint in India for a product purchased abroad, especially if it’s from a global brand with operations in India?
  2. Does the expiry of the 1-year warranty nullify my rights, if the hardware failure is sudden, serious, and not caused by misuse?
  3. If so, what’s the appropriate forum or procedure? Can I use the e-Jagriti platform or should I file through a district consumer forum?
I’ve already contacted Apple support multiple times and escalated the issue without resolution. I’d appreciate any legal guidance on my options, especially since I’ll be in India next month and want to pursue this through proper channels.

The device is out of warranty and has failed suddenly - reliability is beyond warranty and a device of this nature is expected to work reasonably reliably for a longer period beyond standard warranty period of 1 year. The manufacturer - Apple - has offered paid repair as an option without adequate explanation about the nature of the failure or the reason - isn't this adequate grounds for filing a claim against them? Generally, are devices/goods purchased abroad covered by CPA 2019 if the manufacturer does business in India as well?
