BEFORE THE DISTRICT CONSUMER DISPUTES REDRESSAL COMMISSION

IN THE MATTER OF:

COMPLAINT UNDER THE CONSUMER PROTECTION ACT

MOST RESPECTFULLY SHOWETH:

  1. That the complainant had availed a Wi-Fi broadband connection from the Opposite Party (Airtel).
  2. That at the time of installation, the company representative namely Mr. Abhay Agnihotrimisrepresented and provided false information regarding the plan. He stated that:
    • The plan was for 3 months, whereas in reality it was only 70 days.
    • The connection was a prepaid plan, whereas it was actually a postpaid plan.
  3. That such misrepresentation amounts to unfair trade practice and cheating, as the correct details were deliberately concealed from the complainant.
  4. That after installation, the internet service provided was extremely poor and unreliable, causing inconvenience and loss to the complainant.
  5. That the complainant made multiple complaints to the company regarding the poor service quality, but no effective action was taken by the Opposite Party.
  6. That the said representative, Mr. Abhay Agnihotri:
    • Stopped responding to calls
    • Later misbehaved with the complainant when contacted
  7. That despite the deficient service and misleading conduct, the Opposite Party has now started sending emails for overdue bill payments, which were never agreed upon due to:
    • Lack of proper disclosure
    • Fraudulent misrepresentation at the time of sale
  8. That the complainant has refused to pay the said bill, as it was based on incorrect and undisclosed terms.
  9. That such wrongful billing may adversely affect the complainant’s CIBIL score, causing financial harm and reputational damage.
  10. That the acts of the Opposite Party clearly amount to:
  • Deficiency in service
  • Unfair trade practices
  • Mental harassment

PRAYER

In light of the above facts, the complainant humbly prays that this Hon’ble Commission may kindly:

a) Direct the Opposite Party to cancel all outstanding dues raised against the complainant.
b) Direct the Opposite Party to rectify/remove any negative impact on the complainant’s CIBIL score.
c) Award compensation for mental harassment and inconvenience (suggest ₹50,000 or as you deem fit).
d) Award litigation costs.
e) Pass any other order deemed fit in the interest of justice.
