RESULTANTLY, I HAVE TO BEAR 1% ENHANCED REGISTRATION CHARGES AMOUNTING TO RS. 58,120/- DESPITE AFTER REACHING AT A CLEAR CUT UNDERSTANDING VIDE EMAILS DATED 6TH, 7TH & 8TH JULY, 2020 THAT IN CASE OF ANY INCREASE IN REGISTRATION CHARGES BY THE GOVERNMENT, THE SAME WILL BE BORNE BY THE COMPANY FOR THE REASON OF CAUSING DELAY SOLELY AT HIS OWN ACCOUNT.
At the outset it is submitted that I have that till now I have taken up this issue directly with the Builder and Jansunwai portal of the Hon'ble Chief Minister of Utter Pradesh with a view to get the issue sorted out on the footing of Bulldozer system of justice but vide their final findings dated 18.01.2025 in Grievance Registration No. 40014124022723 I am supposed to go this way.

In substantiation of the above factual position necessary details of the case as well as evidentiary papers are mentioned hereunder:-

  1. I, RAJESH CHANDER SAXENA and my wife, MRS. ARCHNA SAXENA have purchased FLAT No E-1106, ARIHANT ARDEN, Sector-1, Greater Noida West. Evident from Possession Letter dated 19.09.2018.
  2. It is evident from point 5 & 9 of the Receipt dated 17.9.18 that even the processing fee for sub lease payable to GREATER NOIDA INDUSTRIAL DEVELOPMENT AUTHORITY & legal charges for Registry have already been cleared up by me on 17.09.2018.
  3. That the Company knowingly and willfully has caused delay in getting the Sale Deed Registered of my Flat on 10.11.2020 for its own reasons as the Company itself has issued even Possession Letter at his own on 19.09.2018 in violation of the Covenant mentioned at Sl. No. 12.2 on page 11 of Agreement dated 17.08.2018 and has raised even no objection at the time of entering into written mutual Understanding that in case of any increase in REGISTRATION FEE by the Government will be borne by the Company vide emails dated 06.07.2020 & 08.07.20 of myself and 07.07.2020 of Company in reply to my email dated 06.07.2020. All evidentiary papers are attached.
  4. It is pertinent to mention here that the Company has grabbed the baseless defence of Covid-19 as my case was of September, 2018 and till the end of 2018 the Company was requesting to wait for Registry for indefinite period as is evident from its reply dated 28.12.2018 in reply to my even dated email. Copy of extract attached.
  5. Copy of Cash Receipt of disputed amount of Rs. 57,120/- is attached.

In view of the above factual position duly substantiated through attached evidentiary papers it is prayed that defaulter Company be directed to refund the disputed amount of Rs. 57,120/- alongwith compensation for damages of unnecessarily retaining Rs. 3,04,400/- by way of processing fee for sub lease, legal charges and stamp duty from 17.09.2018 to 09.11.2020 in addition to mental agony caused to me and my family. Payment with penal interest be awared at the rate as your honour deems fit and proper and oblige.
