CONSUMER COMPLAINT

1. INTRODUCTION
- The Complainant is a senior citizen aged 61 years and is a consumer within the meaning of the Consumer Protection Act, 2019.
- The Opposite Party is a Non-Banking Financial Company (NBFC) providing loan services through digital platform and is a service provider under the Act.
2. FACTS OF THE CASE
- The Complainant had availed a loan from the Opposite Party through its mobile application.
- Due to retirement and lack of regular income, the Complainant faced genuine financial hardship and requested restructuring / settlement in good faith.
- Instead of resolving the issue amicably, the Opposite Party initiated repeated recovery follow-ups including phone calls and field visits.
- The Complainant specifically communicated in writing that:
- He is a senior citizen.
- He does not consent to recovery agent house visits.
- All communication should be made in writing.
- Despite such written objections, the Opposite Party:
- Continued recovery pressure.
- Justified field visits as “standard recovery process”.
- Refused to provide written assurance stopping such visits.
- Left with no alternative, the Complainant issued a Legal Notice dated 27-01-2026:
- Sent by email on the same date.
- Sent by Speed Post with Acknowledgement Due.
- The Speed Post article was attempted for delivery and returned, however the Opposite Party acknowledged email communications after the notice date, demonstrating knowledge of the notice.
- Even during the 15-day notice period, the Opposite Party failed to:
- Stop field visits.
- Provide any written assurance.
- Resolve the issue fairly.
- The continuous recovery pressure has caused severe mental agony, fear and distress to the Complainant.
3. DEFICIENCY IN SERVICE
- The Opposite Party has committed deficiency in service by:
a) Ignoring written objections of a senior citizen.
b) Continuing recovery pressure despite legal notice.
c) Failing to adopt fair and reasonable recovery practices.
d) Causing mental harassment and distress.
- Such conduct amounts to unfair trade practice and deficiency in service under the Consumer Protection Act, 2019.
4. CAUSE OF ACTION
- The cause of action arose when recovery harassment continued despite written objections and legal notice dated 27-01-2026 and continues till date.
5. JURISDICTION
- This Hon’ble Commission has territorial jurisdiction as the Complainant resides within Ranga Reddy District and the cause of action arose within its jurisdiction.
6. RELIEFS SOUGHT
The Complainant respectfully prays that this Hon’ble Commission may be pleased to:
a) Direct the Opposite Party to immediately cease recovery harassment including unwarranted field visits;
b) Direct that all communication be made strictly in writing;
c) Direct the Opposite Party to consider a fair restructuring or settlement proposal in view of the Complainant’s retirement and hardship;
d) Award compensation of ₹50,000 towards mental agony and harassment;
e) Award litigation costs;
f) Pass any other order deemed fit in the interest of justice.
7. INTERIM PRAYER
Pending disposal of the complaint, kindly restrain the Opposite Party from conducting coercive recovery visits.
