I, Aryansh Singh, resident of 37A Rampuram, Shyam Nagar, Kanpur 208013, am a customer of Digiway Net Private Limited (Plot No 46, Block P&T Scheme-1, Fazalganj Industrial Area, Kanpur, U.P. – 208013). I subscribed to their broadband/WiFi service in the month of February'25, with a promise of 200 Mbps speed and paid approximately ₹12,000 upfront for 14 months (Plan of 12 months + 2 months extended), of which ₹9,900 was for the plan and the remaining amount was charged by Digiway for “routing a wire/cable to my area” because they claimed “there was no line” available for my premises.

Despite full payment, I have faced frequent and repeated disconnections, very low internet speeds, and wholly unacceptable service quality throughout the period from March to October 2025. Whenever the issue arises, we’ve had to make multiple calls, suffer for hours without a connection, and only then—after a lot of hassle—do they reluctantly listen. After their attempted correction, the same issue starts persisting again. On multiple occasions my service was unavailable for hours or days, and the speed dropped far below the promised level. When contacting their customer-care I was either ignored or not allowed to talk to any senior or responsible person.

In addition, an employee of Digiway’s sales team—through whom I connected to this service—told me that if there would be any issues, a refund would be given. But now, she and her whole team claim this was not in their policy, which appears to be a false promise and amounts to a scam.

Furthermore, there is business activity by persons working at the same address as Digiway who are associated with Willowave Platform Private Limited (Address: 37-A Ground Floor, Rampuram, Shyam Nagar, Kanpur Nagar, U.P. – 208013). Because of the poor WiFi/internet service I received, our business operations (which rely on online meetings and digital connectivity) suffered a loss of over ₹2 lakhs. We were unable to conduct essential online meetings and projects, directly impacting our business revenue and reputation.

I made several attempts to resolve the matter:

Complaint logged via calls to Digiway – no adequate response.

Follow-ups on calls likewise – no resolution.

Sent a written/registered notice on 26 Sept ’25 requesting rectification or refund – still no action.

This clearly constitutes a deficiency in service under the Consumer Protection Act, 2019 (see Section 2(11) definition).

It also involves unfair trade practices (hidden/undisclosed charges, false promise of refund).

I therefore request the Hon’ble Forum/Commission to direct Digiway Net Private Limited to:

Refund the service fees paid for the period of bad/disrupted service (from February to October) and the additional unjust charge they collected for cable installation amounting to ₹12,000.

Pay compensation of ₹20,000 for mental harassment, inconvenience, business loss, time-waste, and reputational damage.

Provide a guarantee of proper functioning service at the promised speed going forward, or allow termination of the contract without any cost or penalty to me.

Grant any other relief as deemed fit by the Forum.
